1. Service Description

BlueWizarding is an AI-powered business intelligence platform for small and medium businesses. Through guided wizard workflows, you can generate deliverables such as sales battle cards, SWOT analyses, competitive landscapes, and market strategies. Services are delivered digitally in multiple formats (PDF, DOCX, PPTX, PNG, Markdown).

2. Account Registration

You must create an account to use the platform. You can register using Google OAuth or email and password. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access to your account. You must be at least 18 years old to create an account.

3. Credits and Payment

BlueWizarding uses a prepaid credit system. You purchase credit packs, and credits are consumed when you generate deliverables. Key terms:

• Credits are prepaid and must be purchased before use
• Credits are non-transferable between accounts
• Credits do not expire as long as your account remains active
• Each service lists its credit cost before you confirm generation
• If a generation fails, consumed credits are automatically refunded to your balance

Payments are processed securely through Stripe. Prices are listed in USD and are subject to change with notice.

4. Refund Policy

Credit pack purchases are eligible for a full refund within 14 calendar days, provided you have used fewer than 10% of the purchased credits. For complete details, see our Refund Policy.

5. Intellectual Property

Your deliverables: You own the deliverables generated through your use of the platform. You may use, modify, distribute, and commercialize your deliverables without restriction.

Our platform: The BlueWizarding platform, including its software, design, templates, prompt systems, and branding, is our intellectual property. You may not copy, reverse-engineer, or create derivative works of the platform itself. Your right to use the platform is limited to the license granted by these Terms.

6. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or platform systems
• Use automated scripts, bots, or scrapers to access the platform
• Resell, sublicense, or redistribute access to the platform
• Submit false or misleading information through the wizard workflows
• Intentionally overload or disrupt the platform’s infrastructure
• Use the platform to generate content that is defamatory, harassing, or violates the rights of others

We reserve the right to suspend or terminate accounts that violate these guidelines.

7. AI-Generated Content

Deliverables are generated using artificial intelligence and publicly available information. While we strive for accuracy, AI outputs may contain errors, omissions, or outdated information. You are responsible for reviewing and verifying all deliverables before relying on them for business decisions. We do not guarantee the accuracy, completeness, or timeliness of any AI-generated content.

8. Limitation of Liability

To the maximum extent permitted by law, BlueWizarding’s total liability to you for any claims arising from your use of the platform is limited to the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or business losses resulting from your use of the platform or reliance on generated deliverables.

9. Disclaimer of Warranties

The platform and all deliverables are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that generated deliverables will achieve any specific business outcome.

10. Termination

By you: You may delete your account at any time by contacting us. Upon deletion, your personal information and deliverables will be removed in accordance with our Privacy Policy. Unused credits are not refundable upon voluntary account deletion unless you are within the refund window described in Section 4.

By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the platform. We will make reasonable efforts to notify you before termination except in cases of severe violations or legal requirements.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform will be resolved in the courts located in Travis County, Texas.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the platform after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you may close your account before they take effect.
